These Terms of Service (the "Agreement") are an agreement between Cyber Cast International, S.A. ("Zifront" or "us" or "our") and you ("User" or "you" or "your" or "Customer"). This Agreement sets forth the general terms and conditions of using the products and services made available by Cyber Cast International, S.A. and the Zifront website (collectively, the "Services"). By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Services. Cyber Cast International, S.A. reserves the right to change the provided Agreement without notice to our clients. Modification made to the terms does not constitute early contract termination or non-payment.
The present Agreement is subject to the law of the Republic of Panama. The Service and any data you provide to Cyber Cast International, S.A. is subject to the law of the Republic of Panama.
Cyber Cast International, S.A. is committed to protecting the privacy of its Customers. We will not give any personal or corporate information to anyone other than the Panamanian Government through a formal request without further consent or notification to the Customer. We will discard any request for information from our Customers.
This Agreement does not transfer from Cyber Cast International, S.A. to Customer any technology, and all right, titles, and interests in and to Cyber Cast International, S.A. Technology will remain solely with Cyber Cast International, S.A. This Agreement does not transfer from Customer to Cyber Cast International, S.A. any Customer Technology, and all right, titles, and interests in and Customer Technology will remain solely with Customer. Cyber Cast International, S.A. and Customer agree that it will not directly or indirectly reverse engineer, decompose, disassemble or otherwise attempt to derive source code or other trade secrets from the other party and its third-party vendors.
Cyber Cast International, S.A. reserves the right, in sole discretion, to change published prices without notice. Furthermore, we reserve the right to change the Fees for the Services tied to your account upon thirty (30) days advance notice of the applicability of such change to the Fees and shall not apply to Fees already charged to your account.
Cyber Cast International, S.A. reserves the right to modify or discontinue, temporarily or permanently, the Services with or without notice. Cyber Cast International, S.A. shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.
Cyber Cast International, S.A. reserved the right to suspend the account without any notice for any payment not received within four (4) days of the invoice due date. If after fifteen (15) days of not receiving a payment confirmation Cyber Cast International, S.A. reserves the right to terminate the account without any further notice. At this point, we will delete the data.
Any payment is a commitment and cannot be refunded. Any credit in the Customer account cannot be refunded but may be used to pay future or pending invoices. Billing errors can be credited retroactively for up to two (2) months.
Cyber Cast International, S.A. shall not be responsible for any damages your business may suffer.
The Services are provided on an "as is" basis, and Customers use them at their own risk. Cyber Cast International, S.A. does not make, and hereby disclaims, any other express and implied warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement and title, and any warranties arising from a course of dealing, usage or trade practice. Cyber Cast International, S.A. does not warrant that the services will be uninterrupted, error-free, or completely secure.
